4. Membership and Payments

4.1 Membership Tiers

Pictoversity offers different levels of access:

  • Free Access: Limited access to select content
  • Full Membership: Complete access to all content, features, and benefits

4.2 Payment Terms

If you choose to become a full member:

  • You agree to submit payment after registering
  • You must clearly indicate in your payment details which username the payment is associated with
  • All payments are processed securely through our third-party payment processor
  • Membership fees are non-refundable except as required by law or as stated in our refund policy

4.3 Billing and Renewals

  • Memberships may be billed on a monthly or annual basis, as selected during registration
  • Your membership will automatically renew unless you cancel before the renewal date
  • You can cancel your membership at any time through your account settings or by contacting us
  • Cancellations take effect at the end of the current billing period

4.4 Refund Policy

  • Refund requests must be submitted within 14 days of purchase
  • Refunds are provided at our discretion and may be subject to a processing fee
  • No refunds are provided for partial use of a membership period

6.4 Artist and Creator Rights

Artists who contribute content to Pictoversity:

  • Retain ownership of their original work
  • Grant Pictoversity the license described in Section 6.2.2
  • Must ensure they have all necessary rights to submitted content
  • Are responsible for ensuring their content does not infringe third-party rights

7. Content Moderation and Review

7.1 Our Right to Review

We reserve the right to review all content submitted to or posted on our platform. We will:

  • Review content for compliance with our guidelines
  • Only publish content that is thematically aligned with our mission
  • Ensure all content is appropriate for young children (K-12 audience)
  • Remove content that violates these Terms or our content guidelines

7.2 No Obligation to Monitor

While we review content, we are not obligated to monitor all user activity or content in real-time. We reserve the right, but not the obligation, to:

  • Remove or refuse to post any content
  • Take any action we deem necessary regarding content
  • Disclose any content as necessary to comply with legal obligations

13.3 Jurisdiction and Venue

Any legal action arising from these Terms or your use of the Service must be filed in the state or federal courts located in Sheridan,. Wyoming. You consent to the personal jurisdiction of these courts.

13.4 Time Limitation

Any claim or cause of action arising from these Terms or your use of the Service must be filed within one (1) year after the claim arose, or it will be permanently barred.

13.5 Waiver of Class Actions

You agree that any proceedings to resolve disputes will be conducted on an individual basis and not as a class action, consolidated action, or representative action.
